Here’s what you need to know about sponsorship undertaking and your responsibilities.

Obligations as a Sponsor

When you agree to sponsor a family member, you must sign a Sponsorship undertaking. This is a formal promise to provide financial support for the basic needs of your spouse or partner, their dependent children, parents, and grandparents. These needs include:

  1. Basic Living Needs: Food, clothing, shelter, and other everyday living necessities.
  2. Health Care Needs: Dental care, eye care, and other health-related expenses not covered by public health services.

It is crucial that the people you sponsor do not require financial assistance from the government. If they receive social assistance, you will be required to repay the amount. Additionally, you will not be eligible to sponsor anyone else until the debt is cleared.

The undertaking is legally binding and remains in effect for the entire duration specified, regardless of changes in your personal circumstances. This means:

  1. Citizenship Changes: If the person you sponsor becomes a Canadian citizen.
  2. Relationship Changes: If you divorce, separate, or your relationship breaks down.
  3. Relocation: If you or the sponsored person move to another province or country.
  4. Financial Hardships: If you face financial difficulties.

Cancelling Your Undertaking

If you decide to withdraw your sponsorship application after submitting it, you must write a letter to the IRCC before a final decision is made. The cancellation of the undertaking will only be possible if the IRCC approves your request.

Length of Undertaking

The duration of the undertaking varies depending on who you are sponsoring and where you reside in Canada:

– For All Parts of Canada Except Quebec:

  1. Spouse, Common-law Partner, or Conjugal Partner: 3 years from the day they become a permanent resident.
  2. Dependent Child Over 22 Years of Age: 3 years from the day they become a permanent resident.
  3. Dependent Child Under 22 Years of Age: 10 years from the day they become a permanent resident, or until they turn 25, whichever comes first.
  4. Parents and Grandparents: 20 years from the day they become a permanent resident.

– For Quebec:

  4. Parents and Grandparents: 10 years from the day they become a permanent resident.

Eligibility to Sponsor

To be eligible to sponsor your spouse, partner, dependent child, parents, or grandparents, you must meet the following criteria:

  1. Age: You must be at least 18 years old.
  2. Status: You must be a Canadian citizen, permanent resident, or a person registered in Canada as an Indian under the Canadian Indian Act.
  3. Financial Stability: You must not be receiving social assistance for reasons other than a disability.
